Common use of Default by Owner Clause in Contracts

Default by Owner. Owner agrees to act with diligence to: (a) keep common areas reasonably clean, (b) maintain fixtures, furniture, hot water, heating and/or air conditioning equipment, (c) remain in substantial compliance with applicable federal, state, and local laws regarding safety and sanitation, (d) make all reasonable repairs, subject to Resident’s obligation to pay for damages caused by Resident, his guests, or other occupants, and (e) comply in all respects with the Residential Lease and Tenant Act.

Default by Owner. Owner agrees to act with diligence to: (a) keep common all areas reasonably clean, of the apartment complex in a reasonable clean condition; (b) after being served proper notice from resident, owner to maintain fixtures, furniture, hot property water, heating heating, plumbing, electrical service and/or air conditioning equipment, equipment in a habitable condition; (c) remain in substantial compliance with abide by applicable federal, state, state and local laws regarding safety and sanitation, repairs; (d) make all reasonable repairs, subject to Resident’s obligation to pay for damages damage caused by Resident, his gueststheir family, or other occupants, and (e) comply in all respects with the Residential Lease and Tenant Actguests.
