Common use of Default by the City Clause in Contracts

Default by the City. The City shall not be in default unless the City fails to perform obligations required of the City within a reasonable time, but in no event later than ninety (90) days, after written notice by Developer to the City, specifying wherein the City has failed to perform such obligation, provided, however, that if the nature of the City's obligation is such that more than ninety (90) days are reasonably required for performance then the City shall not be in default if the City commences performance within such ninety (90) day period and thereafter diligently pursues such performance to completion.

Default by the City. The City shall not be in default unless the City fails to perform obligations required of the City within a reasonable time, but in no event later than ninety thirty (9030) days, calendar days after written notice by Developer the Chargers to the City, specifying wherein the City has failed to perform such obligation, ; provided, however, that if the nature of the City's obligation is such that more than ninety thirty (9030) calendar days are reasonably required for performance then the City shall not be in default if the City commences performance within such ninety (90) 30-day period and thereafter diligently pursues such performance prosecutes the same to completion.

Default by the City. The City shall not be in default of any obligation under this Agreement unless the City fails to perform obligations required of the City such obligation within a reasonable time, but in no event later which time shall not extend more than ninety (90) days, days after Concessionaire’s written notice by Developer to the City, City specifying wherein the particular obligation that the City has failed to perform such obligationperform, provided, however, that if unless the nature of the City's obligation is such that more than ninety (90) days are reasonably required for performance then performance. In such event, the City shall not be in default if the City commences performance within such ninety (90) day period and thereafter diligently pursues such performance prosecutes the same to completion.
