Defeasance of Certain Covenants Sample Clauses
The "Defeasance of Certain Covenants" clause allows a borrower or issuer to be released from specific obligations or covenants under a contract, typically after meeting certain conditions such as depositing sufficient funds or securities to cover future payments. In practice, this means that once the required assets are set aside, the borrower is no longer bound by restrictive covenants like limitations on additional debt or asset sales. The core function of this clause is to provide flexibility to the borrower or issuer, enabling them to remove ongoing restrictions once their financial obligations are effectively secured, thereby reducing administrative burdens and potential defaults related to covenant breaches.
