Common use of DEFECT LIABILITY Clause in Contracts

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter within a period of 5 (five) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter's failure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter within a period of 5 (five) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter's ’s failure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter within a period of 5 2 (fiveTwo) years by the Allottee from the date of handing over possessionpossession of the Plot, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) thirty days, and in the event of Promoter's ’s failure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter as per the agreement for sale Agreement relating to such development is brought to the notice of the Promoter within a period of 5 (five) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter's failure to rectify such defects within such such, time, the aggrieved Allottees Allottee shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or servicesor any other obligations of the Promoter as per the agreement for sale relating to such development is brought to the tothe notice of the Promoter within a period of 5 (five) years by the Allottee from the date of handing over possession, ,it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) days, and in the inthe event of Promoter's failure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive toreceive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of the services or any other obligations of the Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter within a period of 5 (five1(One) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 60 (thirtySixty ) days, and in the event of Promoter's ’s failure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter as per the agreement for sale this Agreement relating to such development is brought to the notice of the Promoter within a period of 5 (five) five years by the Allottee allottee from the date of handing over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter's failure to rectify such defects within such time, the aggrieved Allottees Allottee(s) shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services (common area) or any other obligations of the Promoter as per the agreement for sale relating to such development (common area) is brought to the notice of the Promoter within a period of 5 (five) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter's ’s failure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter Promoter/Transferor as per the agreement for sale this Agreement relating to such development is brought to the notice of the Promoter Promoter/Transferor within a period of 5 (five) years by the Allottee from the date of handing over possessionPossession Date, it shall be the duty of the Promoter Promoter/Transferor to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter/Transferor's failure to rectify such defects within such time, the aggrieved Allottees Allottee/Transferee shall be entitled to receive appropriate compensation in the manner as provided under the ActApplicable Laws.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanshipinworkmanship, quality or provision of services or any other obligations of the ofthe Promoter as per the agreement for sale relating to such development suchdevelopment is brought to the notice of the Promoter within a period of 5 of5 (five) years by the Allottee from the date of handing over possession, ,it shall be the duty of the Promoter to rectify such defects without further withoutfurther charge, within 30 (thirty) days, and in the event of Promoter's failure Promoter’sfailure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter as per the agreement for sale .sale relating to such development is brought to the notice of the Promoter within a period of 5 (five) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter's failure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter Promoters as per the agreement for sale this Agreement relating to such development is brought to the notice of the Promoter Promoters within a period of 5 (five) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter Promoters to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter's the Promoters' failure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.Act provided however, the Promoters shall not be held liable for any defects or responsible for any rectifications in the circumstances and/or instances detailed in Schedule-N.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of the services or any other obligations of the Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter within a period of 5 (five5(Five) years by the Allottee ALLOTTEES from the date of handing over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 60 (thirtySixty ) days, and in the event of Promoter's ’s failure to rectify such defects within such time, the aggrieved Allottees ALLOTTEESs shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter Promoters as per the agreement for sale this Agreement relating to such development is brought to the notice of the Promoter Promoters within a period of 5 (five) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter Promoters to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter's the Promoters' failure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.Act provided however, the Promoters shall not be held liable for any defects or responsible for any rectifications in the circumstances and/or instances detailed in Schedule- N.

It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter within a period of 5 (five) years by the Allottee from the date of handing over possession, . it shall be the duty of the Promoter to rectify such defects without further any charge, within 30 (thirty) days, and in the event of Promoter's Promoter‘s failure to rectify such defects within such time, the . The aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter as per the agreement Agreement for sale Sale relating to such development is brought to the notice of the Promoter within a period of 5 (five) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter's ’s failure to rectify such defects within such time, the aggrieved Allottees Allottee shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter PROMOTER as per the agreement for sale relating to such development is brought to the notice of the Promoter PROMOTER within a period of 5 05 (five) years by the Allottee ALLOTTEE from the date of handing over possession, it shall be the duty of the Promoter PROMOTER to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter's PROMOTER’s failure to rectify such defects within such time, the aggrieved Allottees ALLOTTEEs shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect defects in workmanship, quality or provision of services or any other obligations obligation of the Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter within a period of 5 (fiveFive) years by the Allottee from the date of handing handling over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirtyThirty) days, and in the event of Promoter's promoter’s failure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter Owner/Vendor as per the agreement for sale this Agreement relating to such development is brought to the notice of the Promoter Owner/Vendor within a period of 5 (five) five years by the Allottee allottee from the date of handing over possession, it shall be the duty of the Promoter Owner/Vendor to rectify such defects without further charge, within 30 (thirty) thirty days, and in the event of PromoterOwner/Vendor's failure to rectify such defects within such time, the aggrieved Allottees Allottee(s) shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter within a period of 5 (five5(five) years by the Allottee Allottees from the date of handing over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter's ’s failure to rectify such defects within such time, the aggrieved Allottees shall will be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter Vendor as per the agreement for sale relating to such development is brought to the notice of the Promoter Vendor within a period of 5 (five) years by the Allottee Allottee(s) from the date of handing over possession, it shall be the duty of the Promoter Vendor to rectify such defects without further charge, within 30 (thirty) days, and in the event of PromoterVendor's failure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter within a period of 5 (five) years by the Allottee from the date dat of handing over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter's Promoter ’s failure to rectify such defects within such time, the aggrieved Allottees Allottee shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter as per the agreement for sale Transfer relating to such development is brought to the notice of the Promoter within a period of 5 (five) years by the Allottee from the date of handing over possessionobtaining the completion certificate, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter's failure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter as per the agreement for sale this Agreement relating to such tosuch development is brought to the notice of the Promoter within a period of 5 (five) five years by the Allottee allottee from the date of handing over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) thirty days, and in the event of Promoter's failure to rectify such defects within such time, the aggrieved Allottees Allottee(s) shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter within a period of 5 1 (fiveone) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoter's ’s failure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quality or provision of services or any other obligations of the Promoter owner as per the agreement for sale relating to such development is brought to the notice of the Promoter owner within a period of 5 (five) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter to rectify such defects without further charge, within 30 (thirty) days, and in the event of Promoterowner 's failure to rectify such defects within such time, the aggrieved Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.
