Common use of Deficiency Decree Clause in Contracts

Deficiency Decree. If at any foreclosure proceeding the Mortgaged Property shall be sold for a sum less than the total amount of indebtedness for which judgment is therein given, the judgment creditor shall be entitled to the entry of a deficiency decree against the Mortgagor and against the property of the Mortgagor for the amount of such deficiency, subject to Applicable Laws; and the Mortgagor does hereby irrevocably consent to the appointment of a receiver for the Mortgaged Property and the property of the Mortgagor and of the rents, issues and profits thereof after such sale and until such deficiency decree is satisfied in full.

Deficiency Decree. If at any foreclosure proceeding the Mortgaged Property Premises shall be sold for a sum less than the total amount of indebtedness for which judgment is therein given, the judgment creditor shall be entitled to the entry of a deficiency decree against the Mortgagor Grantor and against the property (other than Principal Properties, as defined in the Credit Agreement) of the Mortgagor Grantor for the amount of such deficiency, subject to Applicable Laws; and the Mortgagor Grantor does hereby irrevocably consent to the appointment of a receiver for the Mortgaged Property Premises and the property (other than Principal Properties) of the Mortgagor Grantor and of the rents, issues and profits thereof after such sale and until such deficiency decree is satisfied in full.
