Common use of Definition of Combination Product Clause in Contracts

Definition of Combination Product. As used herein, the term "COMBINATION PRODUCT" shall mean a Licensed Product sold by Licensee in a formulation which contains one or more additional Active Ingredients which are the subject of granted patents owned by or assigned to Licensee. For the purposes of this Agreement, "Active Ingredient" shall mean any * CONFIDENTIAL PORTIONS HAVE BEEN OMITTED BASED UPON A REQUEST FOR CONFIDENTIAL TREATMENT PURSUANT TO RULE 24b-2 OF THE SECURITIES EXCHANGE ACT OF 1934 AND HAVE BEEN SEPARATELY FILED WITH THE COMMISSION. composition of matter approved by the United States Food and Drug Administration for the treatment of the same indication(s) as Licensed Product.
