Common use of Delay of Performance Clause in Contracts

Delay of Performance. A morning school day performance may be delayed to begin any time up to 12:00 p.m. (noon), without incurring overtime, no more than twice in a calendar month and only under the below-listed conditions. i. The Producer must prove affirmatively that said delay was directly and totally related to the disruption of transportation or inclement weather which therefore caused the late arrival of the company or the audience. ii. The grace period (see (b) above) for unloading school buses and/or expediting the seating of groups of children may not be used to extend the beginning of a performance beyond 12:00 p.m. (noon).
