Delays Affecting Performance of the TTMS Work. Contractor acknowledges and agrees that a CA Delay Event occurring during the TTMS Work Period will excuse Contractor from performance of its obligations to perform the TTMS Work pursuant to this Agreement but only to the extent that such obligations are directly affected by such CA Delay Event. In addition, during the TTMS Work Period, extensions of milestones or activities identified on the TTMS Work Schedule for CA Delay Events affecting the TTMS Work will be made based on Time Impact Analysis, using the then current Concessionaire approved TTMS Work Schedule and taking into account impacts of the CA Delay Events on Critical Path items, in accordance with the Technical Requirements, and will extend the ▇▇▇▇ Ex Guaranteed Final Completion Date and the ▇▇▇▇ Ex Guaranteed Service Commencement Date. For avoidance of doubt, the ▇▇▇▇ Ex Long Stop Date may be extended in accordance with this Agreement by reason of a CA Delay Event that occurs during the period after the ▇▇▇▇ Ex Guaranteed Service Commencement Date.

  • Performance of the Work The Contractor shall perform all of the Work required for the complete and prompt execution of everything described or shown in, or reasonably implied from the Contract Documents for the above referenced Project.

  • OUTCOME IF GRANTEE CANNOT COMPLETE REQUIRED PERFORMANCE Unless otherwise specified in this Statement of Work, if Grantee cannot complete or otherwise comply with a requirement included in this Statement of Work, HHSC, at its sole discretion, may impose remedies or sanctions outlined under Contract Attachment D, Local Mental Health Authority Special Conditions, Section 7.09 (Remedies and Sanctions).   • Performance Delay Time is of the essence in the Vendor’s performance of this Agreement. If at any time it appears to Vendor that it may not meet any of the performance schedules or the scheduled completion date of the services to be performed for any reason, including labor disputes, Vendor shall immediately by verbal means (to be confirmed in writing) notify Customer of the reasons for and the estimated duration of such delay. If requested by Customer, Vendor shall make every effort to avoid or minimize the delay to the maximum extent possible including the expenditure of premium time. Any additional cost caused by these requirements of Customer shall be borne by Vendor, unless the delay in performance arises out of causes beyond the control and without the fault or negligence of Vendor or its subcontractors within the meaning of the Cancellation- Default clause herein. The foregoing requirements are in addition to any of Customer’s other rights and remedies as may be provided by law or this Agreement.

  • Monitoring of Contract Performance The Contractor shall comply with the monitoring arrangements set out in the Monitoring Requirements Schedule including, but not limited to, providing such data and information as the Contractor may be required to produce under the Contract.

  • Performance by Contractor Where Pur- chaser’s employees, agents, contractors, Subcontractors, or their employees or agents perform Purchaser’s Opera- tions in connection with fire responsibilities, Purchaser’s obligations shall be the same as if performance was by Purchaser.
