The DELIVERY DATE AND LOCATION clause establishes when and where goods or services must be delivered under a contract. It typically specifies a precise date or timeframe for delivery, as well as the exact address or site where the delivery is to occur. DELIVERY DATE AND LOCATION. Supplier will deliver Goods in the quantities and on the date(s) specified in the Order or as otherwise agreed in writing by the parties (“Delivery Date”). Timely delivery of Goods is of the essence. All Goods will be delivered to the address specified in the Order (“Delivery Location”) during normal business hours or as Isola otherwise instructs. If Supplier fails to deliver Goods or complete services as scheduled, Isola may, at Isola’s sole discretion: (a) assess such amounts as may be set on the face of the Order as liquidated damages for the agreed delay period; (b) require Supplier, at Supplier’s cost, to forward all Goods by fastest method to the destination point determined by Isola; (c) buy the undelivered Goods and/or services elsewhere and charge Supplier the excess cost and expenses over the price set forth in the Order; and/or (d) suspend or terminate the Order in accordance with Section 22.

4.2 If trailers are stacked, the contractor will be responsible for ground delivery. Delivery locations may refuse delivery if trailers are stacked, as the DNR may not have means to unload trailers safely.
4.3 All products must be delivered to the DNR with MSO/Titles and inventory sheets, if applicable.

Isola may deliver the Goods in installments. Isola will use commercially reasonable efforts to: (a) meet ▇▇▇▇▇’s stated delivery dates when Customer provides all necessary order and delivery information sufficiently prior to such delivery date; and (b) give as much notice as reasonably possible of any change.
