Common use of Delivery of Fund Documents Clause in Contracts

Delivery of Fund Documents. The Adviser has furnished you with copies, properly certified or authenticated, of each of the following: (a) Agreement and Declaration of Trust of the Trust, as in effect on the date hereof (the “Declaration of Trust”). (b) By-Laws of the Trust as in effect on the date hereof (the “By-Laws”). (c) Resolutions of the Trustees selecting the Adviser as investment adviser and you as a sub-investment adviser and approving the form of this Agreement. The Adviser will furnish you from time to time with copies of all material amendments of or supplements to the foregoing.
