DELIVERY TERMS AND DELIVERY TIME. 13.1 The terms of supply and delivery of the Goods shall be DAP at ISR’s Site (the "Delivery Terms"), subject to Section 13.2. 13.2 The Delivery Time of the Goods shall be at Site (DAP) no later than fourteen (14) days following the issuance of an UTEX Order (the "Delivery Time"). 13.3 Following the receipt of a Refurbished Armature from Supplier, ISR shall make an ISR'S Armature available to Supplier on Site subject to the terms of this Section. 13.4 ISR'S Armature shall be provided to Supplier "As Is" without any warranties including with regards to merchantability, fitness or no infringement. 13.5 All shipping costs and expenses (including packaging, collecting, delivering) risks and insurance of Refurbished Armature and ISR'S Armature (both for shipping from ISR to Supplier and from Supplier to ISR) shall be borne by Supplier at its sole expense. 13.6 ISR makes no warranties, express or implied, including any warranty of merchantability or fitness of the ISR'S Armatures to be provided by ISR to the Supplier under the UTEX Transaction for any use. Supplier shall take responsibility for the use of the ISR'S Armature received from ISR by itself and/or by any third party. Supplier assumes, and shall be solely responsible, and fully releases ISR and anyone on its behalf from any liability or warranty, explicit or implied, in connection with any damage, including indirect, ancillary or consequential damage (“Damage”), in the wake of and/or in consequence of and/or in connection with and/or arising from the fact that any or all representations set forth above are found to be incorrect; and / or Damage caused by use of the ISR's Armature and /or any other use thereof
