Common use of Demands under Letters of Credit Clause in Contracts

Demands under Letters of Credit. If a demand is made under a Letter of Credit or the Fronting Bank incurs in connection with a Letter of Credit any other liability, cost, claim, loss or expense which is to be reimbursed pursuant to this Agreement, the Fronting Bank shall promptly notify the Agent of the amount of such demand or such liability, cost, claim, loss or expense and the Letter of Credit to which it relates and the Agent shall promptly make demand upon the relevant Borrower in accordance with this Agreement and notify the Lenders.

If a demand is made under a Letter of Credit or the L/C Fronting Bank incurs in connection with a Letter of Credit any other liability, cost, claim, loss or expense which is to be reimbursed pursuant to this Agreement, the L/C Fronting Bank shall promptly notify the Facility Agent of the amount of such demand or such liability, cost, claim, loss or expense and the Letter of Credit to which it relates and the Facility Agent shall promptly make demand upon the relevant Revolving Borrower in accordance with this Agreement and notify the LendersBanks.
