Common use of Denial of Application Clause in Contracts

Denial of Application. If BellSouth notifies TelCove that no space is available (“Denial of Application”), BellSouth will not assess an application fee to TelCove. After providing written notice to TelCove that BellSouth has no available space in the requested Premises, BellSouth will allow TelCove, upon request, to tour the entire Premises within ten (10) days of such Denial of Application, or as otherwise agreed to by the Parties. In order to schedule this tour, the request for the tour of the Premises must be received by BellSouth at least five (5) days prior to the tour date.

After providing written notice to TelCove notifying Teleconex that BellSouth has no available space in the requested PremisesRemote Site Location, BellSouth will allow TelCoveTeleconex, upon request, to tour the entire Premises Remote Site Location within ten (10) calendar days of such Denial of Application, or as otherwise agreed to by the Parties. In order to schedule this toursaid tour within ten (10) calendar days, the request for the a tour of the Premises Remote Site Location must be received by BellSouth at least within five (5) calendar days prior to of the tour dateDenial of Application.
