Common use of Departure Criteria Clause in Contracts

Departure Criteria. The Port’s request for a Departure must meet the following criteria: a. Identify how the requested ▇▇▇▇▇▇▇▇▇ meets the intent of the applicable design standard; and, b. Describe how the proposed Departure is part of an overall, thoughtful and comprehensive approach to the design of the project as a whole and how any detrimental effects on adjacent or nearby properties will be mitigated to the greatest extent possible.
