Deposit and Other Fees. 5-1 Both parties agree that Party B shall pay Party A the Deposit equal to the rent of / month in an amount of RMB100,000 when Party A hands over the Premises. RMB Yuan (See Supplemental Provisions) as the security deposit. Upon receiving the security deposit, Party A shall issue a receipt to Party B. Upon expiration of the lease term, the security deposit remaining after the relevant fees payable by Party B are deducted shall be returned to Party B without interest.
Deposit and Other Fees. 5.1. Upon receiving the Deposit, Party A shall issue a receipt to Party B. Upon termination of this lease, the Deposit, as received by Party A hereunder, after offsetting the amounts due and payable by Party B hereunder, shall be refunded to Party B without interest.
5.2. All costs and fees relating to the use of the Premises incurred during the Lease Term, such as water, electricity, communication, equipment, property management, air-conditioning service during non-business hours, parking and energy service, shall be borne by Party B.
5.3. The rules of calculation or allocation, the payment method and time limit of payment for the aforesaid fees and expenses borne by Party B shall be: (refer to the Supplementary Provisions for details).
Deposit and Other Fees. 5.1 Party B shall pay a deposit to Party A. The amount and payment term are included in Schedule 7. In the event that Party B fails to pay off the required deposit prior to the time of the Premises’ delivery, Party A has the right to postpone delivering the Premises.
5.2 During the term of the lease, in the event that Party A suffers any loss caused by Party B’s breach of the Contract, Party A can deduct the actual amount of loss from the deposit as compensation upon receiving the written confirmation from Party B. On this occasion, Party B shall complement the deposit to Party A.
5.3 In the event that the deposit is not enough to compensate Party A’s loss, Party A can seek extra recovery from Party B.
5.4 In the event of expiry of the lease term or an early termination of the Contract, after Party A deducting from the deposit the penalty and other expenses payable by Party B in accordance with the provisions of the Contract, Party A shall send back the balance of the deposit, if any, without interest, to Party B within 15 days prior to the termination of the lease term. In the event that Party A fails to pay back the deposit to Party B on time for its own reasons, Party A shall pay Party B the deposit and the interest incurred thereby.
5.5 Party B shall pay the property management fee as per the rate set forth by Property Management Company (see Schedule 8).
5.6 If the property management fee has reasonably adjusted due to the recruitment of a new property management company or due to the property management company’s increased or decreased costs (including the adjustment of government fees and staff salary), after discussion between the property management company and lessee company and after approval by government authorities for property management, a thirty-day written notice should be given to Party B in advance and Party B shall pay the adjusted property management fee. The property management company shall provide Party B with an audited report provided by an accounting firm regarding the use of the property management fee.
5.7 During the term of the lease, Party B shall pay the property management company on regular basis the cost of utilities and services such as water, electricity, gas and telephone payable as prescribed by the public institutions of the government or proved reasonable by other evidences. Deposit and Other Fees. 5.1 Both parties agree that on the delivery of the Premises by Party A, Party B shall pay a deposit to Party A in the amount equal to X months’ rent, i.e. X (in X currency). (See Article 16
Deposit and Other Fees. (I) The Deposit shall be RMB233,639.36 for the 2nd Floor, RMB137,196.58 for the 4th Floor, which will be RMB370,835.94 in total. Upon the termination of the tenancy, Party A shall offset from the Deposit the fees bearable by Party B hereunder and return the remains to Party B without interest, provided that Party B did not breach the contract during the tenancy.
(II) During the tenancy, Party B shall bear the costs of water, electricity, telecom, property management, parking, and so on, relating to the use of the Premise.
(III) The calculation, method of apportionment, method and time of payment of the above fees born by Party B shall be as follows: Water Fees: Party A has installed a water meter on each floor. Party B shall share water fees in proportion to the area of the Premise according to the reading of the meter. Water fees shall be paid to the property management company of Party A. The property management company of Party A shall collect fees and issue invoices on behalf of the water company. (Water supply shall be charged for RMB1.30 per cubic meter, and drainage shall be charged for RMB3.62 per cubic meter, which shall be adjusted according to the market prices.)
Deposit and Other Fees. 7.1 Both parties agree that Party B shall pay Party A the Deposit in an amount of RMB1,088,197.50 equal to 3 times of monthly rental within 10 days upon the effective date of this Contract (the “Deposit”). On receipt of the Deposit, Party A shall issue a receipt to Party B. If Party B fails to pay all the Deposit according to this contract exceeding 5 days, Party A has right to terminate the contract, and if Party A terminates the contract, Party B shall pay the liquidated damage equal to double amount of monthly rental. During the lease term, the Deposit shall not offset the rental. Upon the expiration of the tenancy, Party A shall return the Deposit without any interest to Party B within 10 days after Party B pays off all the related fees and hand over the Premise. In the event that Party B fails to pay related fees and brings losses to Party A at Party B’s fault, Party A is entitled to deduct from the Deposit and return the remains to Party B without any interest.
7.2 During the tenancy, Party B shall bear the fees of water, electricity, gas, telecommunication, equipment and etc.
7.3 Party B shall directly apply to the related departments for installation of electricity, telecommunication and etc. at its own expenses.
7.4 Party B shall enter into a Property Management Contract with the property management company under which Party B shall bear the property management fee. The property management fee of the Premise is currently rated at RMB7.50 per month per square meter. Party B shall pay the property management fee of the Premise upon the date of handover the Premise.
Deposit and Other Fees. 7.1. DSH shall pay ▇▇▇▇ ▇▇▇▇ a deposit amount of RMB 797,796.69 (“Security Deposit”), equal to the Total Lease Area’s one-month lease fee, within one hundred and eighty (180) calendar days of the Effective Date of this Lease Agreement.
7.2. ▇▇▇▇ ▇▇▇▇, upon receiving the Security Deposit, shall issue an evidentiary receipt of the Security Deposit to DSH. Upon the termination of this Lease Agreement, ▇▇▇▇ ▇▇▇▇ shall return the Security Deposit to DSH minus any portion of fees and/or expenses of DSH as specified in this Lease Agreement.
7.3. Building Management Fee DSH agrees to pay ▇▇▇▇ ▇▇▇▇ Building Management Fee equivalent to the amount of 5% of the total monthly lease for the Total Lease Area referred above at Section 6.5. ▇▇▇▇ ▇▇▇▇ shall provide DSH management services as follows:
(1) guard and security services for the public area outside of the Total Lease Area;
(2) maintenance and repairs of buildings and facilities in the Total Lease Area;
(3) maintenance and repairs of public buildings and areas and public facilities within the Total Lease Area;
(4) maintain cleanliness and sanitation in the Total Lease Area and any public facilities and areas;
(5) maintain landscaping and environment in the Total Lease Area and any public facilities and areas; and
(6) provide other necessary building management services.
7.4. Ground Lease Fee Both Parties agree, upon the Effective Date of this Lease Agreement, that DSH shall pay the ground lease fee for the full 6,688.07 square meters of gross area related to the Total Lease Area. Each square meter shall cost RMB 4.13, and the total monthly ground lease fee shall be RMB 27,621.73.
Deposit and Other Fees. 7.1 Both Parties agree that, Party B shall pay a deposit for leasing the Premises equal to three (3) months rentals, i.e. RMB4,405.56 , within ten (10) days from the date as of the execution hereof (“Deposit”). Party A shall provide receipt to Party A after receiving the aforesaid Deposit. During the Term, Party B shall not offset any rental payments with the Deposit. Upon expiry of the Term, Party B shall pay off all relevant fees and within ten (10) days after Party B completing all formalities in respect of returning the Premise, Party A shall return the Deposit without any interests to Party B. Party A may deduct from the Deposit any unpaid amount and such amount as equal to Party A’s economic losses due to Party B’s causes and return the rest to Party B without any interests.
