Common use of Deposit Prohibitions Clause in Contracts

Deposit Prohibitions. You agree not to deposit, or attempt to deposit, or allow others, either directly or indirectly, to deposit, or attempt to deposit, by any means: a. any check that is originally payable to someone other than you (the owner of the account); b. any check that is originally made payable to more than one party; c. any substitute check, the original of which has already been presented for deposit via MyOCCU Deposit; d. any image of a check that has already been deposited either as an original or as a substitute check; e. any original check, an image of which has already been presented for deposit via MyOCCU Deposit or any similar service; f. any check that you know or suspect, or should know or suspect bears a forged drawer’s signature, is altered, or is otherwise fraudulent or unauthorized; g. any check that is not payable in U.S. currency; h. any check that is dated more than six (6) months before the date of the deposit, or that is dated after the date of deposit; i. any check that is payable through (but not payable at) a U.S. financial institution; j. any check drawn on your own account with OCCU; k. any check that is marked as “non-negotiable;” l. any check that has previously been deposited and returned; m. any check that bears a qualified or conditional endorsement (except for the restrictive endorsement “for OCCU mobile deposit only,” which is required). If you, or any third party, makes, or attempts to make, a deposit in violation of this subsection you agree to defend, indemnify, and hold OCCU and its agents harmless from and against all liability, damage and loss arising out of any claims, suits, or demands brought by third parties with respect to any such substitute check or original check. You agree that the aggregate amount of any items that are deposited more than once will be debited from your account, and to the extent funds in your account are insufficient to cover such amount, any balance shall be debited by OCCU from any other deposit accounts with OCCU in its sole discretion. You further acknowledge that you and not OCCU is responsible for the processing and handling of any original items which are imaged and deposited utilizing the service and you assume all liability to the drawer of any item imaged using the service or liability arising from OCCU's printing of any substitute check from those images.

Deposit Prohibitions. You agree not to deposit, or attempt to deposit, or allow others, either directly or indirectly, to deposit, deposit or attempt to deposit, by any means: a. means any check that is originally ineligible items including but not limited to: • Checks in excess of the Service deposit limit as described in Section 5 of this Agreement • Checks not payable in United States currency • Checks made payable individually or jointly to someone other than you (the who is not an owner of the account); b. any check that is originally on your account • Checks made payable to more than one party; c. party (including tax refund checks and other government checks), unless deposited into an account in the name of all payees • Checks made payable to a third party or checks payable to cash • Checks with any substitute inconsistencies such as the numerical amount not matching the written amount or the payee not matching the account name (e.g. nicknames) • Checks that are stale dated (generally if dated for more than 6 months prior to the date of deposit unless otherwise stated on the check, for example “void after 90 days”). • Checks post-dated with a date after the date of deposit • Checks containing obvious alteration to any of the fields on the front of the check or item, or which you know or suspect, or should know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check or item is drawn. • Checks without the full Magnetic Ink Character Recognition (MICR) line of the face of the check • Checks that are starter, counter or temporary checks • Any Substitute Check, the original of which has already been presented for deposit via MyOCCU Deposit; d. any the Service • Any image of a check that has already been deposited either as an original or as a substitute check; e. check via the Service or through a remote deposit capture service offered at any another financial institution • Any original check, an image the Substitute Check of which has already been presented for deposit via MyOCCU Deposit or any similar service; f. any check the Service • Checks drawn on financial institutions located outside the United States • Checks that you know or suspect, or should know or suspect bears a forged drawer’s signature, is altered, or is otherwise fraudulent or unauthorized; g. any check that is do not payable in U.S. currency; h. any check that is dated more than six (6) months before have the date original manual signature of the deposit, person authorizing the check (facsimile signatures are ineligible) • Checks with any endorsement on the back other than that specified in Section 10 of this Agreement • Checks for which you do not have the original paper check in your physical possession • Checks that have been re-deposited or that is dated after the date of deposit; i. any check that is payable through (but not payable at) a U.S. financial institution; j. any check drawn on your own account with OCCU; k. any check that is marked returned such as “non-negotiable;” l. sufficient funds” or “refer to maker” or returned for any check other reason. • Checks made payable to a custodial and/or account governed by the Uniform Transfers to Minors Act • Checks payable to a trust, trustee, or other fiduciary • Checks to be deposited to an Individual Retirement Account (IRA) • Checks that has previously been deposited require a special endorsement or warranty (e.g. insurance and returned; m. escrow checks) • Checks payable on sight or payable through drafts, as defined in Regulation CC • Checks payable to a business attempting to deposit to a personal account, even if you are the business owner • Checks printed in light ink that does not reproduce a clear image • Non-negotiable checks • Traveler’s Checks • Money Orders • Gift Checks • Savings Bonds • Checks that are in violation of any check federal or state law, rule, or regulation. Deposits of any prohibited checks or items listed in this section may result in the immediate termination of your use of the Service. The Credit Union reserves the right to modify the checks ineligible for deposit through the Service without prior notice.
