Description of the Work. The completion of design, procurement, fabrication, installation and commissioning of the ECMs specified in Schedule A and the Interim Period Training services described in Schedule J, which are integral to the operation of the ECMs, are referred to in this Agreement as the "work". The maintenance and monitoring services detailed in Schedule G and the Post- Acceptance Training services detailed in Schedule J, performance of which does not commence until after the Acceptance Date, are not part of the work. The ESCO shall comply with the provisions of the working conditions set forth in Schedule P at all times during the term of this Agreement.

Description of the Work. The description of the Work as set forth in SCHEDULE A is an accurate description of the scope of activities to be funded in part pursuant to the terms of this Agreement.

The Work consists generally of the construction of certain roads, sidewalks, fencing, sewers, drainage curbs, gutters, grading, retaining walls, landscaping, water lines and utility lines within, and adjacent to, the Homesites, and any physical improvements to common areas within the Property (excluding any improvements which are vertical nature). Contractor may enter into contracts for the performance of the Work with “Subcontractors” (as defined in Section 10 below) that are appropriately licensed in the jurisdiction in which the Property is located, to the extent required by applicable law. For purposes of this Agreement, “Finished Homesite” shall mean, for each Homesite, that all improvements, and all other work and obligations, whether on the site of the Property, or outside the boundaries of the Property, have been constructed, installed or completed to the extent required to obtain a building permit for the construction of a residence upon the payment of the required building permit fees therefor, so that Contractor shall be able to commence construction of a residence on such Homesite upon the payment of such fee and a certificate of occupancy is available upon proper completion of a residence on the Homesite and payment of any hook-up or connection fees for utility services. In addition, the Work shall include the construction and installation of the Property Specific Improvements, if any, set forth on the Exhibit “C” to the Addendum.

Description of the Work. The work to be performed by Contractor, and to be paid for by Buyer, under this Agreement is for the construction of the following: 1) One single family dwelling be built according to drawings shown in Exhibit B. Description of the Work. 2.1 The Contractor will attend at the Premises, within hours of the first accumulation of ” of snow during a Snowfall, to commence snow Clearing once in accordance with the Drawings and Specifications. If a further accumulation 2” occurs during a Snowfall, the Contractor will return to commence a second pass to again Clear the snow within Hours of the end of that Snowfall. The first Snowfalls will be included as part of the Fixed Price Work, after which the Contractor will be paid for each additional Snowfall, as Additional Work, the sum of $ not including applicable taxes. (insert “unlimited” and “nil” if applicable) 2.2 As part of the Fixed Price Work, the Contractor shall at its sole discretion determine when and in what quantities Ice Melting Products are to be applied to the Premises in accordance with the Drawings and Specifications. In determining whether or not and how to apply Ice Melting Products in any particular circumstance, the Contractor shall act reasonably, shall monitor the weather in the vicinity of the Premises and shall apply the standards of the custom of the snow and ice maintenance industry.
