Common use of Design and Construction Clause in Contracts

Design and Construction. Without limiting the Contractor's obligations under the Contract or otherwise at law or in equity, the Contractor must: design the parts of the Works which the Contract requires it to design; and construct the Works, in a manner which: complies with the requirements of the ESD and WOL Plan; and ▇▇▇▇▇▇▇▇▇ the achievement of the ESD Principles and the WOL Objectives.
