The Design-Builder shall be responsible for procuring or furnishing the design and for the construction of the Work consistent with the Commission’s Program, as such Program may be modified by the Commission during the course of the Work. The Design-Builder shall exercise reasonable skill and judgment in the performance of its services consistent with the team relationship described in Paragraph 2.1, but does not warrant nor guarantee schedules and estimates other than those that are part of the GMP proposal. The Design-Builder shall at all times comply in letter and spirit with, and demonstrate good faith efforts to achieve, the affirmative action goals of the Commission and its User Agency, as those goals may be set forth in the MBE/WBE Special Conditions for Design Build Contracts, Book 2, Article 23, attached hereto and incorporated by reference herein, and in any other terms and provisions of this Agreement. Design-Builder’s Responsibilities. Design-Builder’s responsibility for Hazardous Materials shall include the following duties:
(1) Design-Builder shall not keep, use, dispose, transport, generate, or sell on or about the Site any Hazardous Materials, and in no case shall any Hazardous Material be stored more than ninety (90) days on the Site;
(2) Design-Builder shall exclude the use of lead paint and minimize the use of acetone and chlorinated substances at the Site; and
(3) Design-Builder promptly shall notify Owner of: (a) all spills or releases of Hazardous Materials; (b) any failure to comply with Environmental Law or Governmental Rules applicable to Hazardous Materials; (c) all inspections of the Site by any Governmental Unit relative to Hazardous Materials; (d) any and all fines imposed by Governmental Units relative to Hazardous Materials; and (e) all responses or interim cleanup actions taken by or proposed to be taken by any Governmental Unit or private entity on the Site.
Design-Builder’s Responsibilities. The Design-Builder shall be responsible for procuring the design and for furnishing the construction of the Work consistent with the Owner's Program; as such the Owner may modify the Program during the course of the work up to twenty-five (25)-percent design complete. The Design-Builder shall exercise reasonable skill and judgment in the performance of its services consistent with the team relationship described in Paragraph 2.1, but does not warrant nor guarantee schedules and estimates other than those that are part of the GMP Proposal.
Design-Builder’s Responsibilities. 2.1 The Design-Builder shall exercise reasonable skill and judgment in the performance of its services. Architectural and engineering services shall be procured from licensed, independent design professionals retained by the Design-Builder or furnished by licensed employees of the Design-Builder, or as permitted by the law of the State in which the Project is located. The person or entity providing architectural and engineering services shall be referred to as the Design Professional. If the Design Professional is an independent design professional, the architectural and engineering services shall be procured pursuant to a separate agreement between the Design-Builder and the Design Professional. 2.2 The Design-Builder is responsible for the following Preliminary Design-Build Services:
2.2.1 OWNER'S PROGRAM The Design-Builder shall assist the Owner in the development and preparation of the Owner's Program, which is an initial description of the Owner's objectives. The Owner's Program may include budget and time criteria, space requirements and relationships, flexibility and expandability requirements, special equipment and systems, and site requirements.
Design-Builder’s Responsibilities. The Design-Builder also expressly acknowledges that this Project and the Work will proceed on a "fast-track" method of construction, i.e., construction will commence without final Drawings and Specifications in place. More specifically, while Drawings and Specifications are complete for certain portions of Work, the design process will continue for other portions during construction based on the Guaranteed Maximum Price premises and assumptions. The Design-Builder has been, and will continue to be, an active participant in the design process. Given such participation, the Design-Builder represents that it is familiar with the scope and quality of those aspects of the Project that have not yet been fully designed, and has taken such scope and quality matters into consideration in preparing each component of the Guaranteed Maximum Price. The Design-Builder agrees to work with the Department in managing the construction and design work to complete the design process. The Design-Builder shall manage the Project, including coordinating redesign or value engineering necessary or advisable for certain aspects of the Project at any stage of the design process in order to bring the cost of such Work within or below, but not in excess of, the respective allowances or the budgeted or allocated amounts for other items contained in the Guaranteed Maximum Price. Once the Drawings and Specifications are complete, it is recognized by the Design-Builder and the Department that the scope of the Guaranteed Maximum Price may include Work not expressly indicated on the Contract Documents, but which is reasonably inferable from the Contract Documents, and such Work shall be performed without any increase in the Guaranteed Maximum Price or extension of Contract Time, except if and to the extent otherwise expressly provided in this Agreement.
Design-Builder’s Responsibilities. The Design-Builder shall be responsible for procuring or furnishing the design and for the construction of the Work consistent with the Owner's Program, as such Program may be modified by the Owner during the course of the Work. The Design-Builder shall exercise reasonable skill and judgment in the performance of its services consistent with the team relationship described in section 2.1, but does not warrant nor guarantee schedules and estimates other than those that are part of the GMP proposal. The Design-Builder and the Owner may establish a fast-track approach to the design and construction services necessary to complete the Project. Such agreement establishing a fast-track approach and the Schedule of the Work shall be included as an exhibit to this Agreement. In the absence of such agreement, the Parties shall proceed in accordance with sections 3.1 and 3.3 below.
Design-Builder’s Responsibilities. The Design-Builder shall be responsible for procuring or furnishing the design and for the construction of the Work consistent with the Contract Documents. The Design-Builder shall exercise reasonable skill and judgment in the performance of the Work and shall comply with the professional standards for contractors within the State of Georgia.
Design-Builder’s Responsibilities.
3.1 DESIGN SERVICES Pursuant to a mutually agreeable schedule, Design-Builder shall submit for Owner's written approval, Design Development Documents and Construction Documents, based on the Contract Documents in existence at the time of the execution of this Agreement or any further development of Contract Documents that have been approved in writing by Owner.
Design-Builder’s Responsibilities. § 5.1 The Design-Builder shall provide available information in a timely manner regarding requirements for, and limitations on, the Architect’s Portion of the Project, including a copy of the Owner’s Criteria for the Project.
§ 5.2 Within seven days after receipt of the Architect’s written request, the Design-Builder shall request information from the Owner as necessary and relevant for the Architect to evaluate, give notice of, or enforce lien rights. Within seven days of receipt of such information from the Owner, the Design-Builder shall furnish the information to the Architect.
§ 5.3 The Design-Builder shall periodically update the budget information set forth in Section 1.4.
