Developer acknowledges and agrees that in reviewing and approving documents under this Section, Agency is acting as a legal entity separate and distinct from the City and that Agency’s actions in this regard are separate and distinct from the City’s conduct of its typical governmental functions and exercise of its police powers in its governmental capacity.
