Design Service Requirements. 6.1 If Subcontractor or its tier-subcontractor performs design services for the Project, Subcontractor will purchase and maintain or require that tier-subcontractor to purchase and maintain professional liability insurance with limits of at least $2,000,000 per claim and in the aggregate annually, and including the following coverages: punitive damages (where not prohibited by law), limited contractual liability, and a retroactive date that is no later than the date of inception of design services. Such coverage will be maintained in effect for a period of 5 years from the Substantial Completion Date of the Project. Such extended coverage may be obtained through annual renewals on at least as broad as the original policy or through an extended reporting period of not less than 5 years. A certificate of insurance must be submitted prior to commencement of the design per Section 3 above.
