Common use of Designation of Agents Clause in Contracts

Designation of Agents. Agents and employees of edtec having a legitimate educa- tional interest in student record information are hereby designated by the Board as agents of the Academy such that they are authorized access to educational records of the Academy’s students under 20 U.S.C. § 1232g, the Family Educational Rights and Privacy Act (“FERPA”). “Legitimate educational interest” shall be defined as having a responsibility for helping the student achieve one (1) or more of the educational goals of the Academy or if the record is necessary in order for the employee to perform an administrative, supervisory or instructional task or to perform a service or benefit for the student or the student’s family. Except as set forth in this paragraph D, no agent or employee of edtec shall be deemed to be an agent of the Academy.
