DESIGNATION OF THE FLSA CLASS AS AN FLSA COLLECTIVE ACTION. The Court finds that the members of the FLSA Class are similarly situated within the meaning of Section 16(b) of the Fair Labor Standards Act, 29 U.S.C. § 216(b), for purposes of determining whether the terms of settlement are fair. Accordingly, the Court conditionally certifies the FLSA Class as an FLSA collective action.
