Designation of Users. The opening of the Account is made through the Owner who has the rights to represent and engage the Client. The Owner may be a corporate officer or a natural person other than the corporate officer expressly mandated by the Client. In the event of loss by the Owner of his/her rights to the Account (for example, change of the corporate officer or revocation of the Power of attorney of the authorized person), the Client undertakes to inform Paynovate without delay. In the absence of notification or in the event of late notification, the liability of PAYNOVATE cannot be engaged. Moreover, the Client may give Power of attorney to Administrators or Members authorized to use the Services on their behalf and for their account, and under their entire responsibility. The Power of attorney form is available in the Personal Area of the Account’s Owner or Administrator. The power of attorney will only take effect upon receipt by Paynovate of the duly completed form and the required supporting documents. The power of attorney ceases automatically upon the death of the Owner or the Administrator who has issued it. The power of attorney may be revoked by the Client at any time by informing Paynovate through their Personal Area without undue delay. If the notification is not made or is made late, the Power of attorney remains valid and PAYNOVATE cannot be held liable. The Client expressly discloses the obligation of professional secrecy relating to the Payment Account data in respect of Users. The Client determines for each User the scope of the rights he/she has on the Payment Account. Each User is assigned Personalized Security Data of his/her own, in order to access his/her Personal Area. The Personal Area of each User is personalized according to the rights granted to him/her by the Client. The different Users profiles are: Owner, Administrator, and Member.
Designation of Users a) Each User shall be designated as a Primary User or a Secondary User and so identified in Schedule 1.
b) Each additional Secondary User must be sponsored by a Primary User with whom he has, or intends to establish, a Project-related contractual relationship. Notice of his sponsorship shall be sent to all Users by the Contractor and shall constitute an application for an additional User in accordance with the provisions of Sub Clause 13.b).

The Customer expressly discloses the obligation of professional secrecy relating to the Payment Account data in respect of Users. The Customer will add each User the pre-set scope of the rights he/she has on the Payment Account(s). Each User is assigned Personalized Security Data of his/her own, in order to access his/her Personal Area. The Personal Area of each User is personalized according to the rights granted to him/her by the Customer. The different Users profiles are: Owner/Representative (Admin), Employee and Accountant. The rights associated with each User are detailed in Appendix 2.
Designation of Users. Customer shall: (i) enable access of the Service only to Users, and only for Customer's and its affiliated companies' internal business purposes and not for the benefit of a third party, only in accordance with the terms of this Agreement and the Documentation; and (ii) to the extent Customer would be liable, be liable for the acts and omissions of each User as if they were the acts and omissions of Customer; and (iii) solely responsible for the legality , accuracy and quality of all Customer Data.
Designation of Users. (a) At any point in time, the Party providing the CEA Sendout under this Agreement (whether as an Original Quantity or as an Exchanged Quantity) shall be designated the Original User.
(b) At any point in time, the Party receiving the CEA Sendout under this Agreement (whether as an Original Quantity or as an Exchanged Quantity) shall be designated the Capacity Exchange User.
