Designs and Drawings. In respect of the Concessionaire’s obligations relating to the Designs and Drawings for theAdditional Project Facilities, the following shall apply: (a) The Concessionaire shall prepare and submit at its cost, charges and expenses, the Designs and Drawings in conformity with the Technical Specifications, with reasonable promptness and in such sequence as is consistent with the Implementation Schedule, 3 (three) copies of all Designs and Drawings to the Authority and the Independent Engineer for review. (c) Within 15 (fifteen) days of the receipt of the Designs and Drawings, the Independent Engineer shall review the same and convey its observations to the Concessionaire with particular reference to their conformity or otherwise with the Scope of the Project and the Technical Specifications. The Concessionaire shall not be obliged to await for the observations of the Independent Engineer on the Designs and Drawings submitted pursuant hereto beyond the said 15 (fifteen) days period and may begin or continue Construction Works at its own discretion and cost. (d) If the aforesaid observations of the Independent Engineer indicate that the Designs and Drawings are not in conformity with the Scope of the Project or the Technical Specifications, such Designs and Drawings shall be revised by the Concessionaire and resubmitted to the Independent Engineer for review. The Independent Engineer shall give its observations, if any, within 7 (seven) days of receipt of the revised Designs and Drawings. (e) Without prejudice to the foregoing provisions of this Article 12.2, the Concessionaire shall submit to the Authority for review and comments, its Designs and Drawings relating to the Project, and the Authority shall have the right but not the obligation to undertake such review and provide its comments, if any, within 30 (thirty) days of the receipt of such Designs and Drawings. Designs and Drawings. Where designs are prepared by the Company for the Buyer, acceptance of the Contract by the Company is conditional upon such designs having been previously approved in writing by the Buyer and where the Goods are manufactured to designs submitted by the Buyer. The Company undertakes to provide them in strict conformity with such designs but accepts no responsibility in either case for functions or purpose of the Goods. Designs, drawings, photographic images and other media prepared by the Company remain the property of the Company, unless such variation is specifically agreed in writing by the Company prior to confirmation of the Buyers order. The Company reserves the right to use such media for marketing and other purposes.

(4) The customer’s order must be accompanied by sufficient detailed technical information to enable the company to proceed with the order forthwith. (5) The Company is entitled to assume that all drawings, descriptions, specifications and other information supplied by the Customer to the Company whether written or verbal is in all respects completely accurate and in accordance with the Customer’s requirements and provided that the goods or materials supplied in accordance with the Customer’s designs, standards and specifications the Company shall not be responsible for the suitability or quality of the Goods. (6) The cost of preparation of any designs or drawings prepared by the Company shall be met by the Customer.
