Determination of Peak Deficient Parties. A Party shall be considered peak deficient for purposes of subsection 6(i), Adjustments to the Modified Regulation, if its FPLCC is either less than its EAPL in any Period of the Critical Peaking Period or if its FPLCC is greater than its computed Peaking Capability computed pursuant to clause 6(h)(6)(B)(i) above in any other Period.

  • Compliance with Certain Requirements of Regulations; Deficit Capital Accounts In the event the Company is “liquidated” within the meaning of Regulations Section 1.704-1(b)(2)(ii)(g), distributions shall be made pursuant to this Article X to the Unit Holders who have positive Capital Accounts in compliance with Regulations Section 1.704-1(b)(2)(ii)(b)(2).
