Development Contribution. 5.1 The Developer agrees to make, and the Council agrees to accept, the Development Contribution to be applied towards the Public Purpose.
5.2 The Developer must pay the Development Contribution to the Council by bank cheque on or before the Development Contribution Date and time is essential in this respect.

Development Contribution. 6.1 The Developer agrees that prior to the issue of a subdivision certificate for the subdivision of the land, the Developer is to pay Council, by electronic bank transfer to Council’s nominated bank account, the Development Contribution to be used by the Council for the Public Purpose.
6.2 Council agrees:
6.2.1 to accept the Development Contribution as a material public benefit; and
6.2.2 to use the Development Contribution for the Public Purpose.
6.3 The Developer acknowledges and agrees that Council retains sole discretion as to the priority and timing of the Public Purpose.

In order for the commercial development to proceed the subject lots must be rezoned from the current R1 General Residential zoning to B2 Local Centre. It seems prudent to amend the zoning of the proposed recreational land from R1 General Residential to RE1 Public Recreation at the same time. Council is aware that landowners may request Council to purchase land reserved for open space, a public place or public reserve within the meaning of the Local Government ▇▇▇ ▇▇▇▇, if such landowners are suffering hardship. To avoid this circumstance arising the applicant have agreed to enter into this voluntary planning agreement for the dedication of such land free of cost to Council. Development Contribution. 4.1 The Corporation and the Developer to provide Development Contribution
(a) Schedule 4 has effect in relation to the Development Contribution to be made by The Corporation and the Developer under this Agreement.
(b) The Corporation and the Developer must provide the Development Contribution for Stage 1 as follows:
(i) the Developer must undertake the embellishment works on the Stage 1 POS Land; and
(ii) The Corporation must dedicate to the Council the Stage 1 POS Land; and
(iii) the works and land dedications required by this clause must be performed in accordance with Schedule 4.
(c) The Corporation and the Developer must provide the Development Contributions for Stages 2 as follows:
(i) the Developer must undertake the embellishment works the Stage 2 POS Land; and
(ii) if The Corporation has transferred the Stage 2 POS Land to the Developer, the Developer must dedicate to the Council the Stage 2 POS Land;
(iii) if The Corporation has not transferred the Stage 2 POS Land to the Developer, the Corporation must dedicate to the Council the Stage 2 POS Land; and
(iv) the works and land dedications required by this clause must be performed in accordance with Schedule 4.
Development Contribution. This public benefit offer does not exclude the operation of the provisions of Section 61 of the City of Sydney Act 1988. For the avoidance of doubt, LL acknowledges that any contributions payable under Section 61 of that Act will be paid without any offset to any contributions payable under the VPA.
