Common use of Direct assignment Clause in Contracts

Direct assignment. All Expansion Facilities resulting from the Cluster Study are subject to a determination of Direct Assignment of costs. If Bonneville determines that costs for Expansion Facilities should be directly assigned to the Customer, then Bonneville will: (i) exclude such costs from consideration for rolled-in rate treatment under the Commercial Infrastructure Financing Proposal (CIFP) evaluation pursuant to section 5(b), (ii) notify the Customer that this Agreement shall terminate pursuant to section 1(b)(3), and (iii) process the Customer’s TSR in accordance with the OATT.
