Common use of Disability Separation Clause in Contracts

Disability Separation. At any time during a disability leave, extension of disability leave, paid leaves, or an unpaid leave of absence an employee is determined to be unable to perform the essential functions of his position the employee may be disability separated. Such employee shall be afforded the pre-deprivation administrative process contained in this Agreement in Article 38 prior to a proposed disability separation and will have the right to grieve a disability separation.
