DISAPPLICATION OF CERTAIN EVENTS OF DEFAULT. (a)(v) will not apply in respect of Party A. Sections 5(a)(ii), 5(a)(iii), 5(a)(iv), 5(a)(v), 5(a)(vii)(2), (4) (to the extent that it relates to actions taken by Party A or its Affiliates), (6), (7) and (9), and 5(a)(viii) will not apply in respect of Party B. Section 5(a)(vii)(8) will not apply to Party B to the extent that it relates to Sections 5(a)(vii)(2), (4) (to the extent that it relates to actions taken by Party A or its Affiliates), (6) and (7).
