Dispatch Instructions. (a) The Purchaser shall accept all Net Delivered Energy generated by the Facility and delivered at the Interconnection Point. Subject to this Section 5.4, the Seller shall comply with Dispatch Instructions issued by the System Operator, provided, that:
(i) the Dispatch Instructions are consistent with the Technical Limits;
(ii) the Facility can be operated consistent with the Dispatch Instructions in view of the then prevailing Ambient Site Conditions; and
(iii) Seller shall be required to comply only to the extent there is no Scheduled Outage, Maintenance Outage, or Forced Outage in effect or scheduled to occur and which would prevent compliance with such Dispatch Instructions.
(b) The Seller shall not be in breach of Section 5.2 for failure to execute a Dispatch Instruction due to a Non-Project Event, an Afghanistan Political Event, or a Force Majeure Event.

The Generator may but shall not be obliged to comply with any Dispatch Instruction that would require the Generator to operate either Unit beyond its declared Availability or Declared Operating Characteristics at the relevant time unless such Dispatch Instruction is stated to be issued under Emergency Conditions. In Emergency Conditions the Generator shall not be required to operate either Unit beyond its Design Limits or in any manner that would be inconsistent with Prudent Utility Practices.
Dispatch Instructions. 5.1.1 Subject to and in accordance with the terms of this Agreement, on and from the Commercial Operation Date:
(a) CEB may issue Dispatch Instructions to the Company in respect of the Available Capacity:
(i) consistent with and within:
(A) the Functional Specification; and
(B) taking into account any Availability Declaration issued by the Company in respect of the relevant Hour; and
(ii) in accordance with the Operating Procedures, (each a “Dispatch Instruction”).
5.1.2 Availability Declarations shall be issued by the Company to CEB from time to time notifying CEB of any reduction to the Available Capacity of the Facility and following the end of the circumstances causing the Available Capacity to be reduced, the resulting increase to the Available Capacity.
