Common use of Displacement of Employees Clause in Contracts

Displacement of Employees. The employee and the employer agree that supervisors or non-unit personnel shall not be used at any time to displace employees regularly employed in the Bargaining Unit except, in emergencies when union employees are not available or have refused to do the work as assigned except in cases where unsafe conditions are being charged by the employee, instruction and training, unavailability of employees or necessary equipment and incidental work. For the purpose of this provision, an emergency shall be defined as an unforeseen circumstance or a combination of circumstances which call for immediate action.
