Disputes Not Subject to Arbitration. Notwithstanding the above, if a Claim is within the jurisdiction of a small claims (or an equivalent) court, you or we may bring such Claim in that court; however, if the Claim is transferred, removed, or appealed to a different court, it shall be subject to arbitration. Any dispute concerning the validity or enforceability of this Arbitration Agreement or any part thereof must be decided by a court; any dispute concerning the validity or enforceability of the Agreement as a whole is for the arbitrator to decide.
