If funding requests from Indian Tribes exceeded the allocation for a funding 16 cycle year (“oversubscribed”), Appendix D provided that no funds would be distributed until the 17 following year. Id. at 198-199, ¶5.0.5.2.3. After six years, Appendix D required that any funds left in 18 the Tribal Allocation Subaccount would be returned to the trust for reallocation to State Beneficiaries.
