DISTURBING NOISES a. Loud and disturbing noises are not permitted at any time. Sound equipment and musical instruments must be tuned and/or played at a level, which will not annoy other Residents. Oakbrook reserves the right to determine when noise or parties have become a nuisance levels are expected to be maintained at all times, however, Oakbrook imposes a noise curfew starting at 10:00 pm and ending at 8 am.

Any violation of this agreement will considered a material breach of this contract.   • Contamination The presence in, on or under land, air or water of a substance (whether a solid, liquid, gas, odour, heat, sound, vibration or radiation) at a concentration above the concentration at which the substance is normally present in, on or under land, air or water in the same locality, that presents a risk of Environmental Harm, including harm to human health or any other aspect of the Environment, or could otherwise give rise to a risk of non-compliance with any Statutory Requirement for the protection of the Environment.

  • The Site The site of the Project Highway (the “Site”) shall comprise the site described in Schedule-A in respect of which the Right of Way shall be provided by the Authority to the Contractor. The Authority shall be responsible for: (a) acquiring and providing Right of Way on the Site in accordance with the alignment finalised by the Authority, free from all encroachments and encumbrances, and free access thereto for the execution of this Agreement; and (b) obtaining licences and permits for environment clearance for the Project Highway.

  • Overload A regular employee who works an overload in a given year shall receive no less than either: (a) the pro-rata salary for the overload based on the Provincial Salary Scale or the secondary scale on which the employee is placed or (b) a reduction of workload in a subsequent year that is commensurate with the amount of the overload. The conditions governing overloads are as set out in the regular employee’s local collective agreement, subject to the above provision.
