Documentation Delivery. The Contractor shall deliver document in native formats, e.g. Microsoft Word, Excel, etc., as opposed to PDF except as noted below. DigitalGlobe will identify the delivery location, such as a Microsoft Office Sharepoint Server (▇▇▇▇) internet site, and provide Contractor with username and password-controlled access. Documents shall be submitted or made available to DigitalGlobe according to the dates indicated in the list provided in Attachment 1. In the case of deliverables generated in Microsoft Office, such as Word, Excel, PowerPoint, etc; BATC shall populate the document property fields with the following minimum information: Title, Subject, Author, and key words. In the case of deliverables that are not generated in MicroSoft Office, such as BATC drawings, .pdf is acceptable and BATC shall populate the property fields of drawings after they are converted to .pdf format.

Documentation Delivery. Seller shall deliver documentation as set forth in Section 10.1 by the dates set forth therein.

Documentation Delivery. Contractor will deliver 3 copies of the completed Documentation for the the System in hardcopy and electronic pdf format in accordance with the Documentation description, Appendix B, and the Project Schedule, Appendix C. The City may withhold its issuance of the notice of System Acceptance until City receives the completed Documentation.

Documentation Delivery. ThrillRides will procure from the selected Provider and deliver copies of all of the Documentation described above to FXRE by the date referenced in the Initial Statement of Work or in any subsequent Statement of Work, at FXRE’s sole cost and expense. ThrillRides will procure from the selected Provider and deliver copies of any updates to the Documentation to FXRE as set forth in Section 3.1.3 above.

Documentation Delivery. Microsoft has published the Technical Documentation on a publicly available Internet site for use by Company and other software developers. Updates. Except as otherwise provided below with respect to Standards Documentation for Supplemental I.E. Standards, Microsoft will provide updated Technical Documentation for new or changed Covered Protocol(s), Covered Standard(s), Binary File Format(s), and XAML that are implemented in Updates to or successor version(s) of Covered Product(s) released during the Term upon release of the First Beta of the Update or applicable Covered Product(s) (“Preliminary Documentation”). Microsoft will update the Preliminary Documentation for those new or changed Covered Protocol(s), Covered Standard(s), Binary File Format(s), or XAML as implemented in the commercial release version of those Updates(s) or Covered Product(s) (“Final Documentation”) no later than 15 days before those Update(s) or Covered Product(s) are released to manufacturing for commercial release. If there is no beta release, Microsoft will provide Final Documentation no later than 15 days before the applicable Updates or Covered Product(s) are released to manufacturing for commercial release. Commencing March 31, 2010, Microsoft will provide Standards Documentation for Supplemental I.E. Standards: (a) in accordance with the foregoing, where the Supplemental I.E. Standard has been final approved by the applicable standards organization at least 6 months prior to the First Beta of the applicable Update or successor version of Internet Explorer (or 6 months prior to the release to manufacturing for commercial release of such Update or successor version if there is no beta release of such Update or successor version); or (b) otherwise within 6 months after the final approval of the Supplemental I.E. Standards by the applicable standards organization. The warranties set forth in Sections 3.2 – 3.4 above do not apply to Preliminary Documentation, but do apply to Final Documentation.

Documentation Delivery. A. Upon execution of this Agreement, and from time to time thereafter promptly following any amendment or modification of the terms of any of the documents identified below (if applicable), or at any time promptly upon request by Broker, Customer shall deliver to Broker the following documents: (i) certificate of authority and specimen signatures of the persons executing this Agreement along with a copy of all constitutive documents (including any organizational documents, as applicable); (ii) if any person is authorized by Customer to enter into Transactions hereunder on behalf of Customer (an “Investment Manager”), an executed copy of agreement or document governing or evidencing the grant of full discretionary power and authority of the Investment Manager to enter into Transactions hereunder on behalf of Customer and to bind Customer and all its assets (the “Investment Management Agreement”), along with copies of the relevant certificate of authority and specimen signatures; (iii) private placement memorandum or other offering document (if applicable) of Customer, (iv) statement of Customer’s investment policies, procedures, restrictions, or guidelines; and (v) a list of all individuals authorized to enter into Transactions on behalf of Customer. B. Within six calendar months following the end of the relevant fiscal year end. Customer shall deliver to Broker a copy of its most recently available annual report containing audited financial statements for the most recently ended fiscal year certified by its independent public accountants as fairly presenting its financial condition and results of operations for and as at the close of such fiscal year.
