Common use of Documents and evidence Clause in Contracts

Documents and evidence. The obligation of each Bank to make its Commitment available shall be subject to the condition that the Agent, or its duly authorised representative, shall have received: 9.1.1 on or prior to the giving of the Drawdown Notice for the first Advance, the documents and evidence specified in Part 1 of schedule 3, in form and substance satisfactory to the Agent; and 9.1.2 on or prior to the drawdown of each Advance, the documents and evidence specified in Part 2 of schedule 3, in form and substance satisfactory to the Agent.

Documents and evidence. The obligation of each Bank to make its Commitment available shall be subject to the condition that the Agent, or its duly authorised representative, shall have received: 9.1.1 on or prior to , not later than four Banking Days before the giving Utilisation Notice in respect of the Drawdown Notice for the first AdvanceUtilisation is given, the documents and evidence specified in Part 1 of schedule 3, in form and substance satisfactory to the Agent; and 9.1.2 on or prior to the drawdown of each Advance, the documents and evidence specified in Part 2 of schedule 3, 3 in form and substance satisfactory to the Agent.

Documents and evidence. The obligation of each Bank to make its Commitment available shall be subject to the condition that the Agent, or its duly authorised representative, shall have received: 9.1.1 on or prior to the giving of the Drawdown Notice for the first AdvanceLoan, the documents and evidence specified in Part 1 of schedule 3, 2 in form and substance satisfactory to the Agent; and 9.1.2 on or prior to the drawdown of each Advancethe Loan, the documents and evidence specified in Part 2 of schedule 3, 2 in form and substance satisfactory to the Agent.

Documents and evidence. The obligation of each Bank to make its Commitment available shall be is subject to the condition that the Agent, or its duly authorised representative, shall have receivedfollowing conditions precedent: 9.1.1 that, on or prior to before the giving service of the first Drawdown Notice for the first AdvanceNotice, the Agent has received the documents and evidence specified described in Part 1 A of schedule 3, Schedule 3 in form and substance satisfactory to the Agent; andAgent and its lawyers; 9.1.2 that, on or before the Drawdown Date of each Advance but prior to the drawdown of each making such Advance, the Agent has received the documents and evidence specified described in Part 2 B of schedule 3, Schedule 3 in respect of the relevant Ship in form and substance satisfactory to the AgentAgent and its lawyers.

Documents and evidence. The obligation of each Bank to make its Commitment available shall be subject to the condition that the Agent, or its duly authorised representative, shall have received: 9.1.1 not later than two (2) Banking Days before the day on or prior to the giving of which the Drawdown Notice for the first AdvanceAdvance to be drawn down is given, the documents and evidence specified in Part 1 of schedule 3, 3 in form and substance satisfactory to the Agent; and 9.1.2 on or prior to the drawdown of each Advance, the documents and evidence specified in Part 2 of schedule 33 in relation to the Ship relevant to such Advance, in form and substance satisfactory to the Agent.

Documents and evidence. The obligation of each Bank to make its Commitment available shall be subject to the condition that receipt by the Agent, Facility Agent or its duly authorised representative, shall have received: 9.1.1 on the date of this Agreement or prior to the giving of by such later date (no later than three (3) Banking Days before the Drawdown Notice for Date or such shorter period as the first AdvanceFacility Agent may, in its absolute discretion, agree) of the documents and evidence specified in Part part 1 of schedule 3, in form and substance satisfactory to the Agent4; and 9.1.2 on or prior to the drawdown Drawdown Date, of each Advance, the documents and evidence specified in Part part 2 of schedule 34, in each case in form and substance satisfactory to the Facility Agent.

Documents and evidence. The obligation obligations of each Bank to make its Commitment available shall be subject to the condition conditions that the Agent, or its duly authorised representative, shall have received: 9.1.1 on or prior to the giving of the Drawdown Notice for the first Advance, received the documents and evidence specified in Part 1 of schedule 3, 3 in form and substance satisfactory to all of the Agent; and 9.1.2 Banks not later than three Banking Days before the day on which the Drawdown Notice in respect of the first Advance is given. The Agent shall notify the Banks of receipt of such Drawdown Notice and whether or prior to not the drawdown of each Advance, the documents and evidence specified in Part 2 of schedule 3, in form and substance of such documents are satisfactory to the Agent.

Documents and evidence. The obligation of each Bank to make its Commitment available shall be subject to the condition that the Agent, or its duly authorised representative, shall have received: 9.1.1 on or prior to the giving of the first Drawdown Notice for the first AdvanceNotice, the documents and evidence specified in Part 1 of schedule 3, 3 in form and substance satisfactory to the Agent; and 9.1.2 on or prior to the drawdown of each Advancean Advance for a Ship, the documents and evidence specified in Part 2 of schedule 3, 3 in respect of such Advance and the Ship relevant to it in form and substance satisfactory to the Agent.

The obligation of each Bank to make its Commitment available shall be subject to the condition that the Agent, or its duly authorised representative, shall have received: 9.1.1 not later than two (2) Banking Days before the day on or prior to the giving of which the Drawdown Notice for the first AdvanceAdvance to be drawn down is given, the documents and evidence specified in Part 1 of schedule 3, 3 in form and substance satisfactory to the Agent; and 9.1.2 on or prior to the drawdown of Drawdown Date for each Advance, the documents and evidence specified in Part 2 of schedule 33 in relation to the Ship relevant to such Advance, in form and substance satisfactory to the Agent.

The obligation of each Bank to make its Commitment available shall be subject to the condition that that: 9.1.1 the Agent, or its duly authorised representative, shall have received: 9.1.1 , not later than the day on or prior to the giving of which the Drawdown Notice for the first AdvanceAdvance is given, the documents and evidence specified in Part 1 of schedule 3, 3 in form and substance satisfactory to the Agent; and 9.1.2 the Agent, or its duly authorised representative, shall have received, on or prior to the drawdown of each Advance, the documents and evidence specified in Part 2 of schedule 33 in respect of such Advance and the Ship relevant to it, in form and substance satisfactory to the Agent.

The obligation of each Bank to make its Commitment available shall be subject to the condition that the Agent, or its duly authorised representative, shall have received: 9.1.1 on or prior to the giving of day on which the first Drawdown Notice for the first Advanceis given under this Agreement, the documents and evidence specified in Part 1 of schedule 3, 3 in form and substance satisfactory to the Agent; and 9.1.2 on or prior to the drawdown of each Advance, the documents and evidence specified in Part 2 of schedule 33 in respect of such Advance and the Ship relevant to it, in form and substance satisfactory to the Agent.

The obligation of each Bank to make its Commitment available shall be subject to the condition that the Agent, or its duly authorised representative, shall have received: 9.1.1 not later than two (2) Banking Days before the day on or prior to the giving of which the Drawdown Notice for the first Advanceis given, the documents and evidence specified in Part 1 of schedule 3, 5 in form and substance satisfactory to the Agent; and 9.1.2 on or prior to the drawdown of each Advancethe Loan, the documents and evidence specified in Part 2 of schedule 3, 5 in form and substance satisfactory to the Agent.

Documents and evidence. The obligation obligations of each Bank to make its Commitment available shall be subject to the condition that the Agent, or its duly authorised representative, shall have received: 9.1.1 on or prior to the giving of the Drawdown Notice for the first Advance, received the documents and evidence specified in Part 1 of schedule 3, 3 in form and substance satisfactory to the Agent; and 9.1.2 Agent not later than two Banking Days before the day on which the Drawdown Notice in respect of the first Advance is given. The Agent shall notify the Banks of receipt of such Drawdown Notice and whether or prior to not the drawdown of each Advance, the documents and evidence specified in Part 2 of schedule 3, in form and substance of such documents are satisfactory to the Agent.

Documents and evidence. The obligation obligations of each Bank to make its Commitment available shall be subject to the condition that the Agent, or its duly authorised representative, shall have received: 9.1.1 on or prior to the giving of the Drawdown Notice for the first Advance, received the documents and evidence specified in Part 1 of schedule 3, 3 in form and substance satisfactory to all of the Agent; and 9.1.2 Banks not later than three Banking Days before the day on which the Drawdown Notice in respect of the first Advance is given. The Agent shall notify the Banks of receipt of such Drawdown Notice and whether or prior to not the drawdown of each Advance, the documents and evidence specified in Part 2 of schedule 3, in form and substance of such documents are satisfactory to the Agent.

Documents and evidence. The obligation of each Bank to make its Commitment available shall be subject to the condition that the Agent, or its duly authorised representative, shall have received: 9.1.1 not later than two Banking Days before the day on or prior to the giving of which the Drawdown Notice for the first AdvanceAdvance to be drawn down is given, the documents and evidence specified in Part 1 of schedule 3, Schedule 3 in form and substance satisfactory to the Agent; and 9.1.2 on or prior to the drawdown of each Advance, the documents and evidence specified in Part 2 of schedule 3Schedule 3 in relation to the Ship to which such Advance relates, in form and substance satisfactory to the Agent.
