Common use of Double Recovery Clause in Contracts

Double Recovery. The Buyer shall not be entitled to recover any amount pursuant to this Schedule in respect of any claim to the extent that the Buyer or the Company has already recovered any amount in respect of such claim under the Warranties or under any other provision of this Agreement or under a statutory right of recovery, or to the extent that recovery has already been made under this Schedule in respect of the same subject matter.

Double Recovery. The Buyer Purchaser shall not be entitled to recover any amount pursuant to this Schedule in respect of any claim to the extent that the Buyer Purchaser or the any Target Company has already recovered any amount in respect of such claim under the Warranties or under any other provision of this Agreement or under a statutory right of recoverypursuant to any other agreement with any Seller or any company connected with any Seller, or to the extent that recovery has already been made under this Schedule in respect of the same subject matter.

The Buyer Purchaser shall not be entitled to recover any amount pursuant to this Schedule in respect of any claim to the extent that the Buyer Purchaser or the a Target Group Company has already recovered any amount in respect of such claim under the Warranties or under any other provision of this Agreement or under a statutory right of recoverypursuant to any other agreement with the Sellers or any Target Group Company connected with either Seller, or to the extent that recovery has already been made under this Schedule Agreement in respect of the same subject matter.

The Buyer Purchaser shall not be entitled to recover any amount pursuant to this Part of this Schedule in respect of any claim to the extent that the Buyer Purchaser or any of the Company Target Companies has already recovered any amount in respect of such claim under the Warranties or under any other provision of this Agreement or under a statutory right of recoverypursuant to any other agreement with the Seller or any company connected with the Seller, or to the extent that recovery has already been made under this Part of this Schedule in respect of the same subject matter.
