DTSC APPROVAL Clause Samples

The DTSC Approval clause requires that certain actions, transactions, or conditions are subject to the prior review and consent of the Department of Toxic Substances Control (DTSC), a regulatory agency overseeing hazardous waste and environmental compliance in California. In practice, this means that parties must obtain written authorization from the DTSC before proceeding with activities such as property transfers, remediation work, or changes in land use that could impact environmental safety. The core function of this clause is to ensure regulatory oversight and compliance, thereby protecting public health and the environment by preventing unauthorized or unsafe handling of toxic substances.
