Effect of Determination. If the Plan Administrator determines that a Medical Child Support Order is a Qualified Medical Child Support Order or a National Medical Support Notice is deemed to be a Qualified Medical Child Support Order as described in Section A.5, then: i. The Alternate Recipient shall be considered a Dependent Child of the Participant under the Plan. ii. Any payment for benefits in reimbursement for expenses paid by an Alternate Recipient or an Alternate Recipient's custodial parent shall be made to the Alternate Recipient or the Alternate Recipient's custodial parent or legal guardian (or the provider, with the approval of the custodial parent or guardian). A payment of benefits to an official of a State or political subdivision thereof whose address has been substituted for the address of the Alternate Recipient, shall be treated as payment of benefits to the Alternate Recipient for purposes hereof. iii. The Alternate Recipient shall be considered a Participant of the Plan for purposes of the reporting and disclosure requirements of Part 1 of ERISA. iv. Except as provided in Section A.5, coverage of the Alternate Recipient shall be effective as of the latest of: 1. the first day of the month specified in the Order; 2. the first day of the month following the determination by the Plan Administrator; or 3. the earlier of (A) the first day of the month following the receipt by the Plan of the first premium payment required for coverage, if any, or (B) the effective date of a court or administrative order requiring the Employer to withhold from the Participant' s compensation, the Participant' s share, if any, of premiums for health coverage and to pay such share of premiums to the Plan. v. If the Plan and any fiduciary under the Plan acts in accordance with the provisions of these procedures in treating a medical child support order as being (or not being) a Qualified Medical Child Support Order, the Plan's obligation to the Participant and each Alternate Recipient shall be discharged to the extent of any payment made pursuant to such act of the fiduciary.
