Common use of EFFECT OF HOLDING OVER Clause in Contracts

EFFECT OF HOLDING OVER. If Lessee does not renew or extend the term of this Lease as herein provided, and holds over beyond the expiration of the Term hereof, such holding over shall be deemed a month-to-month tenancy only, with Rent payable on the 1st day of each and every month thereafter until the tenancy is terminated in a manner provided by law. Rent during such holdover period shall be at the same monthly level as was payable with respect to the last month of the Term.

If In the event Lessee does not renew or extend the term of this Lease lease as herein provided, and holds over beyond the expiration of the Term term hereof, such holding over shall be deemed a month-to-month tenancy onlyonly at the monthly rent then being paid, with Rent payable on the 1st last day of each and every month thereafter until the tenancy is terminated in a manner provided by law. Rent during such holdover period shall be at the same monthly level as was payable with respect to the last month of the Term.

If Lessee does not renew or extend should remain in possession of the term of this Lease as herein provided, and holds over beyond leased premises after the expiration of the Term hereoflease term following renewal without executing a new lease, then such holding over shall be deemed construed as a tenancy from month to month, subject to all the conditions, provisions, and obligations of this lease, insofar as the same are applicable to a month to month tenancy. Lessor may, by thirty (30) days’ written notice, change the rental and terms of such month-to-month tenancy only, with Rent payable on the 1st day of each and every month thereafter until the tenancy is terminated in a manner provided by law. Rent during such holdover period shall be at the same monthly level as was payable with respect to the last month of the Termtenancy.
