Common use of Effect of Restatement Clause in Contracts

Effect of Restatement. This Agreement shall amend and restate the Original Credit Agreement in its entirety, with the parties hereby agreeing that there is no novation of the Original Credit Agreement and, on the Restatement Effective Date, the rights and obligations of the parties under the Original Credit Agreement shall be subsumed and governed by this Agreement. Following the Restatement Effective Date, the Commitments under the Original Credit Agreement shall no longer be in effect and thereafter only Commitments under this Agreement shall be outstanding until otherwise terminated in accordance with the terms hereof.

Effect of Restatement. (a) This Agreement shall amend and restate the Original Credit Agreement in its entirety, with the parties hereby agreeing that there is no novation of the Original Credit Agreement and, on and from and after the Restatement Effective Dateeffectiveness of this Agreement, the rights and obligations of the parties under the Original Credit Agreement shall be subsumed and governed by this Agreement. Following From and after the Restatement Effective Dateeffectiveness of this Agreement, the Commitments Obligations under the Original Credit Agreement shall no longer be in effect and thereafter only Commitments continue as Obligations under this Agreement shall be outstanding until otherwise terminated paid in accordance with the terms hereof.

This Agreement shall amend and restate the Original Existing Credit Agreement in its entirety, with the parties hereby agreeing that there is no novation of the Original Existing Credit Agreement andAgreement, and on the Restatement Effective Date, the rights and obligations of the parties under the Original Existing Credit Agreement shall be subsumed and governed by this Agreement. Following the Restatement Effective Date, the Loans and Commitments under the Original Existing Credit Agreement shall no longer be in effect and thereafter only Loans and Commitments under this Agreement shall be outstanding until otherwise terminated in accordance with the terms hereof.

Following the Restatement Effective Date, the Commitments under the Original Credit Agreement shall no longer be in effect and thereafter only Commitments under this Agreement shall be outstanding until otherwise terminated in accordance with the terms hereof.

This Agreement shall amend amends and restate restates the Original Unamended Credit Agreement in its entirety, with the parties hereby agreeing that there is no novation of the Original Unamended Credit Agreement andAgreement, and on the Amendment and Restatement Effective Date, the rights and obligations of the parties under the Original Unamended Credit Agreement shall be subsumed and governed by this Agreement. Following the Amendment and Restatement Effective Date, the Commitments under the Original Credit Agreement shall no longer be in effect Loans and thereafter only Commitments under this Agreement shall be outstanding until otherwise terminated in accordance with the terms hereof.

Effect of Restatement. This Agreement shall amend and restate the Original Credit Agreement in its entirety, with the parties hereby agreeing that there is no novation of the Original Credit Agreement and, on the Restatement Effective Closing Date, the rights and obligations of the parties under the Original Credit Agreement shall be subsumed modified in accordance with and governed by this Agreement. Following the Restatement Effective Date, the Commitments under the Original Credit Agreement shall no longer be in effect and thereafter only Commitments under this Agreement shall be outstanding until otherwise terminated in accordance with the terms hereof.
