Effective Date and Termination of Agreement. 42.1. This Agreement shall remain in full force and effect commencing on the lst day of January, 2014, through the 3lst day of December, 2016. Either party may serve upon the other a notice no earlier than one hundred twenty (120) days prior to the expiration of this Agreement as noted above, that they wish to enter into collective bargaining sessions to negotiate a new contract. In the event of receipt of such notice, the parties shall determine mutually agreeable times and shall commence negotiations for a new contract. 42.2. To the extent required by MCL 423.215 (7), an Emergency Manager appointed under the Local Government and School District Fiscal Accountability Act (being MCL 141.1501 et seq) may reject, modify, or terminate provisions of this collective bargaining agreement as provided in the Local Government and School District Fiscal Accountability Act. The Parties agree that should Local Government and School District Fiscal Accountability Act be overturned though the courts or modified by the State of Michigan in such a way that this notice is not required, such provision shall be deemed void.
