Common use of Effectiveness of Definitive Documentation Clause in Contracts

Effectiveness of Definitive Documentation. All conditions to the effectiveness set forth in the Amendment to the Shareholders Agreement, the Amended and Restated Registration Rights Agreement and the New Nominating Agreements (the “Definitive Documentation”) shall have occurred or been waived in accordance with the terms thereof (other than the consummation of this Agreement) and the transactions contemplated by the Definitive Documentation (in the form attached to, or as otherwise provided in, the Support Agreement upon execution and delivery thereof) shall not have been amended or modified in any material respect without the consent of the Initial Investors;
