Common use of ELECTRONIC SIGNATURE SYSTEM Clause in Contracts

ELECTRONIC SIGNATURE SYSTEM. The Contractor and the Sub-Contractor both agree that: a) if an Electronic Signature System is specified at the Sub-Contract Particulars, all signatures required to sign or execute an ESS Executed Document will be in the form of an electronic signature, whether digital or encrypted, and will be signed or executed in accordance with the Electronic Signature System; b) any ESS Executed Document will have the same force and effect as a document which would be signed or executed by hand. c) an ESS Executed Document will be issued in an electronic portable document format (.pdf), or any other format as directed by Total to be used. d) service of an ESS Executed Document in accordance with clause 13A and 13B will have the same effect as service of the same document if it was bearing a hand signature.
