Common use of Eligible Items Clause in Contracts

Eligible Items. You agree to scan deposit only “checks” as that term is defined in Federal Reserve Regulation CC (“Reg. CC”). Checks you scan deposit, that are issued and drawn by you, may incur a fee if returned for nonpayment. (Refer to the Rate and Fee Schedule for the fee amount.) When the image of the check transmitted to ACU is converted to an Image Replacement Document for subsequent presentment and collection, it shall thereafter be deemed an “item” within the meaning of Articles 3 and 4 of the Uniform Commercial Code. You agree that you will not scan and deposit any of the following types of checks or other items which shall be considered ineligible items: a. Checks or items payable to any person or entity other than you. b. Checks payable jointly, unless deposited into an account in the name of all payees. c. Checks containing an alteration on the front of the check or item, or which you know or suspect, or should know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check is drawn. d. Checks previously converted to a substitute check, as defined in Reg. CC. e. Checks not payable in United States currency. f. Checks drawn on a financial institution located outside the United States. g. Checks dated more than 6 months prior to the date of deposit. h. Checks that are remotely created checks, as defined in Reg. CC. i. Checks payable on sight or payable through Drafts, as defined in Reg. CC. j. Checks that have previously been submitted through the Service or through a remote deposit service offered at any other financial institution. k. Checks with any endorsement on the back other than that specified in this agreement. l. Checks or items prohibited by ACU’s current procedures relating to the Services or which are otherwise not acceptable under the terms of your ACU account.

Eligible Items. You agree that you will use the Mobile Deposit Service to scan deposit only “checks” checks as that term is defined in Federal Reserve Regulation CC (“Reg. Reg CC”). You agree that you will not scan use the Mobile Deposit Service to photograph and deposit any of the following types of checks or other items as shown below which shall be considered ineligible items: a. 1. Checks or items payable to any person a third party (rather than to Customer, unless the Bank agrees in writing otherwise with respect to Customer’s Designated Affiliates); 2. Remotely-created checks, or entity remotely-created payment orders deposited into or cleared through the check clearing system; 3. Checks drawn on banking institutions outside the U.S. or in currencies other than you.U.S. Dollars; b. 4. Irregular checks (e.g., where the numerical and written amounts are different); 5. Previously-returned checks; 6. Checks payable jointly, unless deposited into an account to or in the name of all payees.cash; c. 7. Checks containing an alteration on the front of the check exceeding any Customer transaction or item, file limits as Bank may establish from time to time; 8. Checks that Customer knows or which you know or suspectsuspects, or should know or suspect, are altered on the front of the item, fraudulent or otherwise not authorized by the owner of the account on which the check is checks/items are drawn.; d. Checks previously converted to a substitute check, as defined in Reg9. CC. e. Checks not payable in United States currency. f. Checks drawn on a financial institution located outside the United States. g. Checks dated more than 6 months prior to the date of deposit. h. Checks that are remotely created checks, as defined in Reg. CC. i. Checks payable on sight or payable through Drafts, as defined in Reg. CC. j. Checks that have previously been submitted through the Service or through a remote deposit service offered at any other financial institution. k. Checks that are drawn or otherwise issued by ACU’s current procedures relating to the Services U.S. Treasury Department; 12. Checks that are postdated or which more than six (6) months old; and 13. Checks that are otherwise not acceptable under to Bank for deposit into an Account as provided in the terms Account Agreement, or are in violation of your ACU accountany law, rule or regulation.
