Emergency Actions. A. Emergency actions are those actions deemed necessary by NASA as an immediate and direct response to an emergency situation, which is a disaster or emergency declared by the President or the Governor of the Commonwealth of Virginia, or other immediate threats to life or property as determined by the NASA WFF Director. Emergency actions under this Agreement are only those implemented within thirty (30) calendar days from the initiation of the emergency situation. B. If the emergency action has the potential to affect NRHP-listed or eligible properties, the NASA WFF HPO shall notify the SHPO and other consulting parties as appropriate prior to undertaking the action, when feasible. As part of the notification, the NASA WFF HPO shall provide a plan to address the emergency. The plan shall include the basis for the proposed action and photographs of the current building, facility, or area under consideration. The SHPO shall have seven (7) calendar days to review and comment on the plan to address the emergency. If the SHPO or other consulting parties fail to provide comments within the seven (7) calendar day review period, the NASA WFF HPO may assume that the non- responding party has no comments. The NASA WFF HPO shall take all comments received into consideration when preparing the final plan and then may implement the plan. C. If the NASA WFF HPO is unable to consult with the SHPO prior to carrying out emergency actions the NASA WFF HPO shall notify the SHPO and other parties as appropriate within five (5) calendar days after the initiation of the emergency action. This notification shall include a description of the emergency action taken, the effects of the action(s) to historic properties, and, where appropriate, any further proposed measures to avoid, minimize, or mitigate potential adverse effects to NRHP-listed or eligible properties. D. Where possible, such emergency actions shall be undertaken in a manner that does not foreclose future preservation or restoration of historic properties. Where possible, and where such emergency actions may affect such properties, they shall be undertaken in a manner that is consistent with the Secretary's Standards to the greatest extent practicable. In addition, where possible, such actions will be done with on-site monitoring by the appropriate preservation professional who meets, at a minimum, the Professional Qualifications Standards in his or her field or discipline. E. Immediate rescue and salvage operations conducted to preserve life or property are exempt from these and all other provisions of this Agreement.

Emergency actions implemented under this Agreement are only those response actions related to undertakings from the NPS Cultural Resources Financial Assistance Programs listed in Appendix A, currently within their period of performance, and implemented within thirty (30) 30 calendar days from the initiation of the emergency situation.
B. If In the event the NPS, the recipient, and the subrecipient (if applicable), agree that an emergency action has the potential to affect NRHP-listed or eligible historic properties, the NASA WFF HPO shall notify NPS will:
1. Notify the SHPO appropriate SHPO/THPO, identifying the shortened review time, and other consulting parties as appropriate any Federally recognized Tribe(s)/NHO(s) that may attach cultural and religious significance to historic properties likely to be affected prior to the undertaking the action, when feasible. As part of the notification, the NASA WFF HPO shall provide a plan and afford them an opportunity to address the emergency. The plan shall include the basis for the proposed action and photographs of the current building, facility, or area under consideration. The SHPO shall have seven (7) calendar days to review and comment on the plan to address the emergencyemergency within 7 calendar days of notification. If the SHPO SHPO/THPO and other parties do not comment or other consulting parties fail object to provide comments the plan within the seven (7) calendar day review period, the NASA WFF HPO may assume that the non- responding party has no comments. D. Where possible, such emergency actions shall be undertaken in a manner that does not foreclose future preservation or restoration of historic properties. Where possible, The SHPO/THPO and other parties will have 7 calendar days to review and comment on the proposal where such emergency actions may affect such properties, they shall be undertaken in a manner that further action is consistent with required to address the Secretary's Standards emergency. If the SHPO/THPO and other parties do not object to the greatest extent practicable. In additionplan within the review period, where possible, such the NPS and recipient will implement the proposed plan.
C. These emergency procedures apply only to actions will be done with on-site monitoring that are implemented within 30 calendar days after the disaster or emergency has been formally declared by the appropriate preservation professional who meets, at a minimum, authority. The NPS may request an extension of the Professional Qualifications Standards in his or her field or disciplineperiod of applicability from the ACHP prior to the expiration of the 30 calendar days.
E. Immediate rescue and salvage operations conducted to preserve life or property are exempt from these and all other provisions of this Agreement.
