The Emergency Events clause defines how contractual obligations are affected when unforeseen and extraordinary events, such as natural disasters, war, or government actions, occur. Typically, this clause outlines the types of events considered emergencies, the procedures for notifying the other party, and the temporary suspension or modification of obligations during the emergency period. Its core function is to allocate risk and provide a clear process for handling disruptions, ensuring that neither party is unfairly penalized for circumstances beyond their control.
Emergency Events. VDOC will use VRI at VDOC Correctional Facilities for medical emergencies, if an in-person Qualified Interpreter would have otherwise been the appropriate auxiliary aid or service for that inmate in that context. If remote interpreting services are not appropriate in the situation, VDOC personnel will work in conjunction with Medical staff to secure an in-person Qualified Interpreter or other auxiliary aids or services as soon as possible. Life-saving and other emergency medical care should never be delayed because qualified interpreter services are not available.
Emergency Events. These assignments are not regularly scheduled, and by definition, are related to emergency events. Emergency Events. 6.7.1 The Operator agrees that if during the Operating Period, any portion of the Terminal is rendered unsafe on account of any Emergency Event, the Operator will restrict the performance of its obligations, to such portion of the Terminal which is safe and not effected by the said contingency. The Operator will not be responsible for the maintenance of the Functional Guarantees for such portions of the Terminal, which have been affected by any Emergency Event, as long as the said Emergency Event has not occurred due to any act or omission of the Operator or its negligence or Wilful Misconduct, or any breach of the provisions of this Contract.
6.7.2 Notwithstanding anything to the contrary herein, but subject to this Article 6.7, the Operator may take any operating action as it deems to be necessary in accordance with Good Industry Practices and being guided by the relevant provisions of the WBG EHS Guidelines in the case of an Emergency Event to mitigate the effects thereof or where the Operator considers immediate action to safeguard lives or property.
6.7.3 The Operator shall develop and implement, in line with Environmental Standards, an emergency preparedness and response plan to deal with emergency scenarios while clearly defining roles and responsibilities in case of any Emergency Event. Upon the occurrence of an Emergency Event, the Operator will forthwith notify the Authority of the same and the actions taken. Following such notification, the Parties will discuss without delay, the further actions which should be taken to mitigate the effects of the Emergency Event.
6.7.4 If the Authority considers that any Emergency Event has occurred, the Authority may give notice (which may be oral notice with subsequent written notice) to the Operator specifying the nature of the Emergency Event, which it has identified and the manner in which it requests such Emergency Event to be rectified. The Operator will take all actions to mitigate the effects of such Emergency Event with due diligence. If the Operator fails to comply with such notice promptly, the Authority will be entitled to procure by itself or through any Third Party, such actions, as may be necessary, to remedy such breach by the Operator.
6.7.5 The Operator shall make the necessary arrangements at the Terminal available, for meeting exigencies of the Emergency Events, as per the instructions of the Authority.

In case of an emergency (including a significant process safety event such as fire, explosion, Natural Gas release, LNG release, or sabotage; incident involving loss of life, serious injury to any employee, subcontractor, or third party, or serious property damage; strikes and riots; or evacuations of Lessee's personnel or Personnel) or in anticipation of an emergency situation occurring in the near-term, the Lessee shall have the right to take all necessary and proper measures for the protection of life, health, the environment and property in accordance with the provisions of Schedule 8 (HSSE Requirements) and the Operations Manual, and this Agreement shall continue in accordance with its terms.
Emergency Events. Emergency events may necessitate abbreviated liaison procedures. DOT will make all efforts to give as much advanced notice as possible. In emergency situations DNR shall submit its recommendations concerning the project to DOT on an expedited basis.
Emergency Events. In an emergency the Council may:
5.17.1 enter the Property at any time without giving notice to the Tenant;
5.17.2 close the Property for such period as the Council reasonably considers necessary; and
5.17.3 prevent the Tenant from entering the Property, or require the Tenant to leave and stay out of the Property.
Emergency Events. (1) If there is an Emergency Event or if we reasonably believe that an Emergency Event may occur, we may evacuate and/or relocate you from the Residence for the period during which the Emergency Event affects, or in our reasonable belief may affect, the Residence, the care recipients or staff.
(2) You acknowledge that we may make all decisions and perform all actions which we believe are reasonably necessary to maintain your safety and that of other care recipients at the Residence before, during and after an Emergency Event.
(3) Our decision to evacuate or relocate you is subject to:
(a) our assessment of the severity and duration of the Emergency Event and the likelihood of the Emergency Event affecting you, other care recipients or the Residence;
(b) the availability of alternative accommodation during the Emergency Event; and
(c) directives and warnings from local, State or Commonwealth authorities and emergency services.
(4) If you are required to vacate or evacuate, we must use our best endeavours to provide you with a safe and secure environment and otherwise comply with our obligations under the Aged Care Act.
(5) To the full extent permitted by law, you release and discharge us from:
(a) all liability, damages, injury, claims or costs incurred by or accruing to you as a result of us exercising our powers pursuant to this clause; and
(b) any damage or loss caused to your property as a result of us evacuating or relocating you from the Residence. except to the extent caused, or contributed to, by our negligence.
(6) If we evacuate and/or relocate you, your obligations under this Agreement continue and there is no abatement of any payment to be made by you except where required by law. D10 Extra Conditions Any Extra Conditions which apply are set out in Part J. If there is an inconsistency between an Extra Condition and another provision of this Agreement, the Extra Condition prevails. D11 When this Agreement ends
(1) This Agreement will end on your death.
(2) You can end this Agreement by giving us 7 days’ written notice of your intention to permanently leave the Residence or any shorter period of notice we accept provided you leave on the notified or agreed date;
(3) We can elect to end this Agreement in the following circumstances:
(a) if the Residence or part of the Residence is closing;
(b) if you do not commence continuous occupation in the Residence on the Entry Date, and we give you at least 7 days’ notice in writing of our expectation that y...
Emergency Events. 841 In the event the district declares an emergency, as defined in Article 2.3 and school closures occur, 842 the following protocol shall be followed:

If at any time during the Concession Term an Emergency Event occurs then the Concessionaire shall immediately notify the Grantor of the occurrence of such Emergency Event and shall immediately implement any relevant procedures set out in the Emergency Response Plan. If the Concessionaire believes that the Emergency Response Plan is insufficient to deal with the particular circumstances of the Emergency Event it shall notify the Grantor immediately and the Parties shall meet to formulate a course of action to avert the effects of or alleviate the Emergency Event.
