Emergency Response Plan. The Emergency Response Plan (ERP) must describe procedures to be used in the event of an accident or emergency at the Project Area (for example, power outages, water impoundment failure, treatment plant failure, slope failure, etc.). The ERP must include: Name of the person or entity responsible for responding in the event of an emergency incident; Plan and date(s) for meeting(s) with the local community, including local, State, and federal agencies involved in the cleanup, as well as local emergency squads and hospitals; Spill Prevention, Control, and Countermeasures (SPCC) Plan (if applicable), consistent with the regulations under 40 C.F.R. Part 112, describing measures to prevent, and contingency plans for, spills and discharges; Notification activities in accordance with ¶ 3.13(b) (Release Reporting) in the event of a release of hazardous substances requiring reporting under Section 103 of CERCLA, 42 U.S.C. § 9603, or Section 304 of the Emergency Planning and Community Right-to-know Act (EPCRA), 42 U.S.C. § 11004; and A description of all necessary actions to ensure compliance with ¶ 3.13 (Emergency Response and Reporting) of the SOW in the event of an occurrence during the performance of the RD Work that causes or threatens a release of Waste Material from the Site that constitutes an emergency or may present an immediate threat to public health or welfare or the environment.
Emergency Response Plan. The ICDS Plan must develop and implement as necessary, an ODM approved Emergency Response Plan (ERP), for natural disasters and other public emergencies (e.g., floods, extreme heat, power outage, extreme cold, etc.). Coordination with other appropriate systems is recommended (e.g. American Red Cross). The ICDS Plan must address the following related to the ERP:
2.5.3.3.5.4.6.1. The ICDS Plan must indicate how identification of Beneficiaries will occur who will be most at risk for harm, loss, or injury during any potential natural, technological, or man-made disaster.
2.5.3.3.5.4.6.2. The ICDS Plan must also describe how and when the ERP will be implemented. The ICDS Plan will report immediately to the CMT when the ERP has been activated.
Emergency Response Plan. The Emergency Response Plan as described in Schedule 18 (Technical Requirements) is specified in Appendix 9, as attached and forming part of this Schedule, and shall be amended or supplemented by the Contractor as required in accordance with Schedule 18 and in accordance with the procedure set out in Schedule 5 (Design and Plan Certification Process and Review Procedure).

Emergency Response Plan. (a) Before the commencement of any Train Services the End User must cause the Operator to develop and submit to Aurizon Network a plan (Emergency Response Plan) which:
(i) contains the set of procedures developed by the Operator which are adequate for dealing with an Incident, including all actions to be taken to minimise or alleviate any threat or danger to any person or property or the environment;
(ii) must at all times during the Term be compatible with the Emergency Procedures and this Agreement.
(b) If Aurizon Network is not reasonably satisfied that the Emergency Response Plan submitted under clause 25.1(a) complies with clause 25.1(a), then, within 10 Business Days after receipt of the Emergency Response Plan under clause 25.1(a), Aurizon Network must notify the End User.
(c) If Aurizon Network gives a notice under clause 25.1(b) and the Parties cannot agree on a mutually acceptable course of action to address Aurizon Network’s concerns within 10 Business Days after the date of Aurizon Network’s notice under clause 25.1(b), then either Party may refer the matter to an Expert for determination in accordance with clause 35.3.
(d) If a matter is referred to an Expert for determination as contemplated in clause 25.1(c), then:
(i) the Expert is required to determine whether or not the Emergency Response Plan:
(A) is reasonably compatible with the Emergency Procedures and this Agreement; and
(B) otherwise complies with clause 25.1(a); and
(ii) if the Expert determines that the Emergency Response Plan:
(A) is not compatible with the Emergency Procedures and otherwise complies with clause 25.1(a), then the Expert must determine how the non-compliance should be rectified and the End User must cause the Operator to rectify the Emergency Response Plan accordingly; or
(B) is compatible with the Emergency Procedures and otherwise complies with clause 25.1(a), then the Emergency Response Plan must be treated as complying with clause 25.1(a).
(e) If, after receipt of an Emergency Response Plan under clause 25.1(a), Aurizon Network does not give the End User a notice under, and within the time required by, clause 25.1(b), then the Emergency Response Plan will be taken to be the Emergency Response Plan given to Aurizon Network under clause 25.1(a).
Emergency Response Plan. CITY shall have a plan, updated on an annual basis, to maintain operations during the occurrence of emergencies such as, but not limited to periods of adverse weather or other emergency conditions including, but not limited to, inclement weather, hurricane, earthquake, fire, flood, cloudburst, cyclone, or other natural phenomenon of a severe and unusual nature, act of a public enemy, epidemic, quarantine, restriction, embargo, or other periods of extreme or catastrophic events. Plans for backup telecommunications such as cellular phones, backup generators and backup fuel sources and other alternatives shall be detailed in a written plan and submitted to COUNTY thirty (30) days from the effective date of this Agreement.
Emergency Response Plan. Prior to commencement of construction or operation of the Project, Developer shall prepare and provide to the Town a copy of a site- specific Emergency Response Plan (ERP). A copy of the ERP shall be kept on Site during construction and operation of the Project.
