Common use of Emergent Situations Clause in Contracts

Emergent Situations. In the event operations cannot commence or continue as normal when so directed by civil authorities; or because of other government regulations; or the interruption of work is caused by an Act of God, civil disruption, acts of terrorism or other such uncontrollable, emergent events, the Authority and the Union will meet to discuss the impacts of the emergency on daily operations. The CEO or designee shall have the ability to temporarily modify work assignment provisions of the Agreement that reasonably relate to the Authority’s response to the emergency situation. All provisions of the Agreement shall be followed once the emergency situation is determined to be ended. The CEO or designee shall ensure there is no loss of employment for employees, or any loss of pay or benefits because of the work assignment changes. All work assignment changes will be discussed with the Union before being implemented. Should a disagreement arise as to the reasonableness of any work assignment change, such challenge may be submitted by the Union to arbitration.
